Spanish nationality value of simple presumption
Spanish nationality value of simple presumption applies to those born in Spain whose parents are originally from certain countries outlined in Spanish law. If those countries do not pass on nationality to the child due to birth outside their territory, Spain grants the child nationality to prevent statelessness.
This assumption is defined in article 17.1, section c, of the Civil Code:
Those born in Spain to foreign parents, if both lack nationality or if neither of their countries’ laws grant nationality to the child.
