Spanish nationality value of simple presumption

It is obtained by those persons born in Spain, whose parents are originally from certain countries provided for in Spanish law. However, if the national law of any of these countries does not transmit its nationality because the minor was born outside its territory (in the case of countries that do not recognize as nationals those born outside their territory), Spain recognizes the Spanish nationality of the minor in order to prevent the minor from lacking nationality.

That is to say, the minor acquires Spanish nationality with the value of simple presumption.

This assumption is included in article 17.1, section c, of our Civil Code, which defines nationals of origin:

Those born in Spain of foreign parents, if both lacked nationality or if the legislation of neither of them attributes a nationality to the child.
